Suspects Rights Advisement
TDS attorneys can assist and advice Soldiers who are suspected of an offense. Soldiers cannot be interrogated or requested to provide a statement without first:

Informing the Soldier of the nature of the offense or accusation;

Advising the Soldier that he/she has a right to remain silent regarding the offense of which he/she is accused or suspected; and,
-
Informing the Soldier that any statement made by him/her may be used as evidence in a trial by court-martial.
Soldiers also have a right to consult with an attorney and to have an attorney present at the interrogation. All communications between a client-Soldier and the TDS office are confidential. Soldiers suspected of an offense should follow the Request for Counsel Instructions.
