Non-judicial Punishment (aka Article 15)

 

Commanders can affect a Soldier’s pay, rank and liberty with a non-judicial proceeding under Article 15 of the Uniform Code of Military Justice. In some cases, this punishment can also affect the Soldier’s military career. Although TDS attorneys are not required to appear at non-judicial proceedings under Article 15, they can expertly assist Soldiers with understanding the process, evaluating the charges, assessing the evidence, securing the testimony of defense witnesses or documents, preparing evidence in mitigation or extenuation, and appeals. All communications between a client-Soldier and the TDS office are confidential. Soldiers facing an Article 15 should follow the Request for Counsel Instructions.
