Rules for Posting Content to JAGCNet Document Libraries
Post responsibly. Exercise sound judgment in contributing content, and in your reliance upon shared content. If in doubt, ask a mentor or supervisor. Supervisors should develop local guidance for posting content originating from a legal office.
Practice OPSEC. Do not post classified information, passwords, locations, personnel movements, or other sensitive data.
Protect confidential material. Do not upload content protected by the attorney-client or confidential work product privilege, or pertaining to pending litigation. The attorney-client privilege is that of the client and not of the lawyer; only the client can waive the privilege. When the Army is the client, the head of the organization served by the attorney holds the privilege. See the Army as Client provision of AR 27-26.
Mark materials as FOUO when not appropriate for public release. Information that has not been given a security classification pursuant to the criteria of an Executive Order, but which may be withheld from the public for one or more of the reasons cited in FOIA exemptions 2 through 9, shall be considered as being for official use only. See AR 25-55, para 4-100.
Protect Personally Identifiable Information (PII) of third parties. See DoDD 5400.11, E2.2.
Respect copyrights, trademarks, rights of publicity, and other third-party rights.
Organize. Post content in the most appropriate location. Avoid redundant posts – before uploading content, check whether it is already uploaded to a document library. If a document fits in more than one category, upload it in the “best” place and cross-reference in other relevant locations by creating a link.
Comment. Any user can use the “Comment” feature to make a substantive comment (favorable or critical) as to the accuracy, completeness, or currency of a document.
